The Kerala high court informed that the Crime Branch can continue their investigation against the Enforcement Directorate (ED). However, the court directed that they should not proceed to actions like arrest until the verdict is pronounced. The court will pronounce the verdict on the petition filed by the ED requesting to quash the FIR of the Crime Branch, on April 16.
The ED had approached the high court seeking a stay on the investigation by the Crime Branch. However, the court refused to stay the probe. Though it allowed to continue the investigation, the court also directed not to take actions like arrest.
The ED had approached the Kerala high court raising allegations against the Crime Branch. The ED officials alleged in the court that the Crime Branch is fabricating evidence against the ED and misusing the legal procedures.
The ED also informed the high court that the FIR is creating an extraordinary crisis for them. This has been stated in the counter-affidavit submitted by the ED in response to the arguments of the state government.
The ED alleged that high level people are involved in the letter written by gold smuggling case accused Sandeep Nair and that this was an attempt to sabotage the investigation into the case.
As an FIR is registered, charging a new case is contempt of the court, the ED stated. They further alleged that Sandeep Nair’s complaint was the result of the cooked up stories by the Crime Branch.
